Private Label Paper Shredders Found to Infringe Fellowes Patent
Itasca, IL, USA (May 21, 2007) - Fellowes, Inc., the world's leading designer and manufacturer of paper shredders, today announced
that the U.S. District Court for the Eastern District of Virginia found in Fellowes' favor in its patent infringement suit against Michilin Prosperity Company, Ltd. of Taiwan and Intek America, Inc. of Torrance, California. On May 18, 2007, a jury returned a verdict that Michilin and Intek infringed Fellowes Safety Switch Patent and affirmed the validity of that patent as well as another patent related
to cutting disks for shredders. The Court is expected to rule shortly on infringement of Fellowes' second patent, which Fellowes contends is infringed by diamond-cut shredders.
With this verdict, the jury determined that all paper shredders sold by Michilin or Intek under various store brands and private label brands, which contain a child resistant safety switch, infringe Fellowes' Safety Switch patent.
The damages phase of the case is scheduled to begin July 17, 2007. In the meantime, Fellowes expects to file a motion for a permanent injunction against future manufacture, use, sale, or import into the United States of the infringing products.
